The following Terms & Conditions apply to all treatments and services provided by VITALITY – Practice for Physiotherapy & Training.
By booking an appointment, these Terms & Conditions are deemed accepted.


1. Scope and Formation of Contract
The contractual relationship is established when an appointment is agreed and a treatment contract is concluded between the patient and the practice.
The contract exists exclusively between the patient and the practice. No contractual relationship is established between the practice and any statutory or private health insurance provider or other third-party payers.
By booking an appointment, patients insured under statutory health insurance schemes also conclude a treatment contract pursuant to §§ 611 et seq. of the German Civil Code (BGB).

2. Treatment and Patient Obligations
Treatment is provided at the patient’s request and in accordance with recognised professional standards. A specific therapeutic outcome cannot be guaranteed.
Patients are obliged to provide all information relevant to treatment, in particular information regarding their health status, completely and truthfully.
Where medically necessary, the patient releases the practice from its duty of confidentiality vis-à-vis treating physicians or co-treating therapists insofar as this serves the optimisation of treatment.
Active participation by the patient is recommended but not mandatory. The practice is entitled to discontinue treatment if the necessary relationship of trust no longer exists or if therapeutic measures are repeatedly refused.

3. Treatment Duration
Treatment duration is based on the prescribed or agreed service. Deviations in individual cases are possible and do not constitute a defect or entitlement to price reduction.

4. Liability
The practice shall only be liable for damages caused intentionally or by gross negligence. Liability for simple negligence is excluded insofar as no essential contractual obligations are violated.
No liability is assumed for loss of or damage to personal belongings brought onto the premises, unless caused intentionally by the practice.

5. Fees and Pricing
Fees are charged in accordance with the practice’s current price list and with reference to the GebüTh (Fee Schedule for Therapists).
Patients are expressly informed that there is no uniform fee schedule for physiotherapy services in Germany and that reimbursement by insurance providers may vary.
For privately insured patients, self-paying patients and patients entitled to benefits, a separate price list applies.
The current price list is available at the practice and online.

The price list valid at the time of treatment shall apply.


6. Payment Terms
Invoices are payable within 14 days from the invoice date, without deduction, unless otherwise agreed.
The practice reserves the right to request payment on site or by bank transfer.

7. Appointment Cancellations
Appointments are binding.
A cancellation free of charge is only possible if made at least 24 hours before the scheduled appointment.
Cancellations may be made by phone, email or in person. Timely receipt of the cancellation is decisive.

8. Missed Appointments / Cancellation Fees
If an appointment is not attended or not cancelled in due time, the practice is entitled to charge a cancellation fee equivalent to the agreed or customary treatment fee, as the appointment cannot be reallocated at short notice.
These costs are not reimbursed by health insurance providers and must be paid privately.

9. Late Arrival
In the event of late arrival, the treatment time will be reduced accordingly. There is no entitlement to extension or rescheduling.
Delays of more than 15 minutes are considered a missed appointment and may be charged in accordance with section 8.

10. Withdrawal by the Patient
The patient may withdraw from the treatment contract at any time. Services already rendered must be paid in full.
Withdrawal must be submitted in writing at least 48 hours prior to the next scheduled appointment.

11. Withdrawal by the Practice
The practice is entitled to withdraw from the contract if the patient violates these Terms & Conditions, repeatedly fails to attend appointments without notice, or if the therapeutic relationship is significantly disrupted.
Services already rendered shall become immediately payable.

12. Home Visits and Additional Costs
Additional costs may arise for home visits. These are based on distance and individual agreement.

13. Default of Payment
In the event of late payment, the practice is entitled to charge default interest in accordance with § 288 BGB. Additional reminder or collection costs may apply.

14. Data Protection
Personal data are processed exclusively in accordance with applicable data protection laws. Further information can be found in the Privacy Policy published on the website.

15. Place of Performance
The place of performance is the practice premises or, in the case of home visits, the place where the service is rendered.

16. Amendments to the Contract
Amendments or additions to this contract must be made in writing. Oral side agreements do not exist.

17. Severability Clause
Should any provision of these Terms & Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the intended economic purpose.

18. Applicable Law
These Terms & Conditions are governed exclusively by the laws of the Federal Republic of Germany.
